1. About ReturnVisit
ReturnVisit ("we", "us", "our") is a software platform that helps registered massage therapists and other healthcare practitioners send automated SMS reactivation messages to their existing clients. By creating an account and using ReturnVisit, you ("you", "the therapist", "the subscriber") agree to these Terms and Conditions in full.
2. Your Responsibilities as a Subscriber
You are solely responsible for:
- Ensuring that every client you upload has an existing business relationship with your practice and that contacting them complies with applicable law.
- The accuracy and legality of the client data you upload, including phone numbers and appointment records.
- The content of any SMS messages sent through the platform, including any customizations you make to the default message template.
- Honouring all opt-out requests promptly. Any client who replies STOP must not be contacted again.
- Maintaining your own records of client consent where required by your profession's governing body.
3. CASL Compliance
Canada's Anti-Spam Legislation (CASL) permits sending commercial electronic messages to existing clients under an implied consent exemption, provided a business relationship exists. You represent and warrant that:
- You have an existing business relationship with each client you upload.
- Your use of ReturnVisit complies with CASL and any other applicable federal or provincial law.
- You will not upload contacts who have previously unsubscribed or asked not to be contacted.
ReturnVisit is a technical platform only. We are not the sender of record under CASL — you are. Any regulatory liability arising from your use of the platform rests solely with you.
4. Subscription and Billing
- ReturnVisit is billed monthly at the rate shown at the time of signup.
- Your subscription renews automatically each month until cancelled.
- You may cancel at any time through your account's billing portal. Cancellation takes effect at the end of the current billing period — there are no partial refunds.
- We reserve the right to change pricing with 30 days' notice to your registered email address.
5. Data and Privacy
- We store client contact information (name, phone number) and appointment dates only. We do not store clinical notes, health information, or any other personal health data.
- Your data is stored in Canada using Supabase's Canadian region.
- We will never sell your data or your clients' data to third parties.
- Upon cancellation, you may request deletion of all your data by contacting us.
6. Limitation of Liability
To the maximum extent permitted by law:
- ReturnVisit is provided "as is" without warranties of any kind.
- We are not liable for any regulatory fines, penalties, or legal costs you incur as a result of your use of the platform.
- Our total liability to you for any claim arising from these terms or your use of the platform shall not exceed the fees you paid in the three months preceding the claim.
7. Termination
We reserve the right to suspend or terminate your account immediately if we believe you are using the platform in violation of these terms, applicable law, or in a way that may harm other users or third parties.
8. Governing Law
These terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein.
